Cryptocurrency Exchange Binance to Pay $4.5 Billion to Settle U.S. Probe

 

Binance, the world’s largest cryptocurrency exchange, has agreed to pay $4.5 billion to settle a U.S. government investigation into its anti-money laundering and sanctions compliance practices.



The settlement, announced by the Securities and Exchange Commission (SEC) and the Department of Justice (DOJ), is the largest ever for a cryptocurrency company. Binance was accused of failing to register as a money services business with FinCEN, the U.S. Treasury Department’s financial crimes enforcement network.



The SEC also alleged that Binance made false statements about its compliance with AML and sanctions laws and that it failed to properly monitor its platform for suspicious activity.



Under the terms of the settlement, Binance will pay a $1.8 billion fine to the SEC and a $2.7 billion fine to the DOJ. The company will also be required to register with FinCEN and hire an independent monitor to assess its AML and sanctions compliance program.



“Today’s action against Binance is the largest cryptocurrency enforcement action in history,” said SEC Chair Gary Gensler. “It should be clear by now that we will not tolerate crypto trading platforms that fail to meet their regulatory obligations.”



The settlement is a major victory for the SEC and the DOJ, and it is likely to send a strong message to other cryptocurrency exchanges that they need to play by the rules.

In addition to the fines, Binance has also agreed to:

  • Register with FinCEN as a money services business
  • Hire an independent monitor to assess its AML and sanctions compliance program
  • Cooperate with ongoing investigations by the SEC and the DOJ


The settlement is a major blow to Binance, but it is also a sign that the U.S. government is serious about regulating the cryptocurrency industry. The SEC and the DOJ are likely to continue to scrutinize cryptocurrency exchanges in the years to come, and other exchanges should take note of Binance’s settlement.
